MSME Samadhaan is a web portal facilitated by the Indian Government where micro & small enterprises (MSEs) in India can file a claim for recovery of their delayed payments against the buyers or who availed services.
On MSME Samadhaan Portal MSEs can file their claim/complaint for recovery of dues against the buyers or who availed services online.
Once a complaint is filed MSME Samadhaan portal automatically generates a notice to the buyer. And the buyer then has to respond within a stipulated period.
The complaint is also forwarded to the MSME Facilitation council which is set up by the State governments for handling the MSE’s claims or grievances.
Upon such forward MSME facilitation council takes care of compulsorily time-bound conciliation proceeding and if conciliation in such proceedings fails MSME facilitation council refers the complaint the mandatorily statutory arbitration of the dispute.
Such arbitrator then adjudicate the dispute as per the provisions of Arbitration & Conciliation Act, 1996, which provision is speedy and easier than a regular court.
The award passed by the Arbitrator carries same force as a decree passed by the court.
One of the important aspect of this proceeding is that the claimant can claim interest at the rate i.e. 3 time of the bank rate notified by RBI.
So, even if rate of interest is not agree upon, the supplier or service provider can claim the aforesaid rate of the interest as per section 16 of MSME Act.
As per law, these interest compound monthly.
So, the MSME claim gets better interest rate than normally awarded in a commercial suit.
