What is a mutation of property?

Mutation of the property simply means the entry of new ownership of a property in the Govt Records.

In other words, the mutation is the substitution of the name of a person by the name of another in relation to the property in the Govt. records showing the right or title of the property.

When do you require mutation of property?

If you are a resident of Delhi and you have :

1. recently purchased a property (residential house, flat, land or commercial property, or

2. property has been devolved upon you through succession or will, or

3. a property has come to be owned by you through any other legal means e.g. Gift, Exchange, relinquishment etc.

You are required to give notice of such transfer of ownership or devolution to the Municipal Corporation as per the provisions of section 128(5) of the Delhi Municipal Corporation Act, 1957.

The above is in the case of freehold property and to bring the new owner’s name on the Municipal council’s record.

You are also required to give notice of such transfer or devolution to DDA (Delhi Development Authority) or L&DO (Land & Development Office) in the case of a leasehold property.

Thus, mutation of property is required to be done in both cases i.e. in the case of a freehold property as well as in the case of a leasehold property.

MCD mutation or mutation in MCD is required when a property is a freehold property.

This is mutation is for the purpose of property tax.

House mutation

House mutation or mutation of house property.

In the case of leasehold residential plots allotted by DDA, DDA mutation is required to bring on Govt. record the name of the new owner of the property.

When the property is a leasehold residential plot allotted by or falling within the jurisdiction of the Land and development office, the Land and development office mutation is required to bring on Govt. records the name of the new owner of the property.

If the house property is a freehold property, then the mutation is required to bring on record the new name of the owner on MCD records.

Commercial property mutation

Commercial property mutation or Commercial shops mutation.

In the case of leasehold commercial property allotted by DDA, DDA mutation is required to bring on Govt. record the name of the new owner of the property.

When the property is leasehold property allotted by or falling within the jurisdiction of the Land and development office, the Land and development office mutation is required to bring on Govt. record the name of the new owner of the property.

If commercial property or shop is a freehold property, then the mutation is required to bring on record the new name of the owner on MCD records.

Land mutation

Land mutation on the revenue records.

If it is a leasehold residential plot allotted by DDA or L&DO.

If the respondent plot is a freehold property, then the mutation is to be MCD i.e. MCD Mutation.

Flat mutation

In the case of leasehold residential flat allotted by DDA, DDA mutation is required to bring on Govt. record the name of the new owner of the property.

If the house property is a freehold property, then the mutation is required to bring on record the new name of the owner on MCD records.
