MSME Award Appeal here we mean and discuss Appeal against the order, decree or Award arising out of the statutory arbitration proceeding under MSME Act. There have been challenges to this provision in courts, where the contentions were raised that this provision is not mandatory and there can be deviation by the Appellate court. Thus, the Supreme Court has made it clear that the provision of section 19 of the MSME Act is mandatory in nature..

The timely inflow of money for the services you provided or goods you sold is necessary for the business.

The situation may compel extreme measures like litigation for MSME dues recovery.

If money is received sooner and there is an effective mechanism of law in place, the mechanism which is smooth, efficient and supportive to the business houses, they are not going to bear the jolt.

Here comes into play the MSME Act, of 2006, which provides an effective mechanism for timely MSME dues recovery.

MSME dues recovery procedure

MSME Act, 2006 provides payments against the supply of the goods or services to be made to MSME within a period of 15 days or a maximum of 45 days from the date on which such claim accrues, for example, the date of the invoice.

If money is not received within such days, a claim for such MSME payment of money along with interest can be filed before the MSME Facilitation Council established by State Govt.

Such a claim is filed at the Facilitation Council where such MSME is registered.

Section 16 contains the provision of statutory interest rate i.e. the 3 times the bank rate notified by RBI. And this interest rate is compounding at the monthly interval as per law.

The provisions of conciliation, and statutory arbitration provide an effective and time-saving mechanism.
