When initiating litigation for the recovery of money or dues from buyers, protracted litigation often comes to mind. Additionally, jurisdictional issues, the cumbersome process of enforcing the court’s decree, and other factors complicate the situation.
Litigants often find it intricate and perplexing to approach a court for money recovery. This is especially true when seeking payment from the person or institution to whom they have supplied goods or services.
Small businesses need a steady cash flow to survive. However, when buyers delay payments for goods or services, these businesses struggle to stay afloat.
The MSME Act offers an effective process for recovering dues or money from buyers. As a result, micro and small enterprises can easily use this process to collect payments.
MSMED Act, 2006 provides an effective mechanism for MSME claim recovery provisions.
Sections 15 to 18 outline the laws and procedures for MSME claim recovery. Section 19 covers provisions for appealing against the order or decree passed. Section 22 mandates an audit of the buyer’s account, which benefits the MSME claim recovery process. Additionally, Section 24 states that the provisions of the MSMED Act override all other laws.
MSEs i.e. Micro and small enterprises can file MSME claims against their buyers before the MSME Facilitation council within the jurisdiction they are registered.
MSMEs can file claims if buyers fail to make payments within 15 days. They must file the claim within a maximum of 45 days from the due date.

Execution of Arbitral Award
Once the arbitration proceeding passes an award or decree, the respondent or defendant must pay. If the respondent buyer does not pay, the claimant must execute the award or decree against them.

Challenge or objection to the award by respondent
When the award is passed against the Buyer or respondent, the respondent must take action to challenge the award. They must file an objection in the court under section 34 of the Arbitration & Conciliation Act, 1996, read with section 19 of the MSMED Act.
We help and assist the respondent in preparing the objection and also to file and generally represent the respondent before the court in such objection or challenge.
Challenge or objection to the award by the claimant
If the arbitration proceeding does not grant any award or relief prayed for, the claimant may file an objection. They can challenge the arbitral award under section 34 of the Arbitration & Conciliation Act, 1996, read with section 19 of the MSMED Act.
We help and assist the claimant in preparing the objection and also to file and generally represent the claimant before the court in such objection or challenge.
If the arbitration proceedings require filing an appeal against any interim order, we assist our clients in preparing the appeal. Additionally, we represent our clients before the court.

If the arbitration proceedings require filing an appeal against a final order, we assist our clients in preparing the appeal. Furthermore, we represent our clients before the court.
